1. Non-Refundable Payments (Section 65, Indian Contract Act, 1872)
All payments made to Kharakwal Media are considered as service fees and are strictly non-refundable under any circumstances. Once the service is commenced, no refund shall be entertained, whether partial or full.
2. Service Cancellation (Indian Contract Act, 1872 – Section 73)
Clients may choose to discontinue or cancel services at any point; however, such cancellation will only stop future services. No refund, credit, or adjustment shall be issued for the remaining service period.
3. Resolution of Issues
In case of any service-related dispute, Kharakwal Media shall take reasonable measures to resolve the issue within its control. However, refunds will not be processed. Instead, alternative solutions or adjustments may be provided.
4. Exceptional Refund Cases (Company’s Discretion – IT Act, 2000 & RBI Guidelines)
In rare cases where the company decides to approve a refund, it shall be:
- Subject to internal verification process, which includes but is not limited to:
- Client’s KYC documents (Aadhaar Card, PAN Card, Business Registration, GST Certificate, etc.)
- Proof of original payment (UPI ID, Bank Statement, Transaction Receipt, or Card Statement).
- Signed refund request form provided by the company.
- Processing timeline: 30–60 business days from date of approval.
- Refunds will only be issued through the original payment method (UPI, Bank Transfer, Credit/Debit Card, etc.), as per RBI’s Payment Settlement Act, 2007.
5. Chargeback Protection (As per RBI & NPCI Guidelines)
Any attempt by the client to initiate an unauthorized chargeback, payment reversal, or fraudulent dispute through their bank, card issuer, or payment gateway will be considered as a breach of contract. In such cases, the company reserves the right to:
- Suspend all ongoing and future services.
- Recover losses, legal expenses, and penalties from the client.
- Pursue legal remedies under the Information Technology Act, 2000 and the Indian Penal Code (IPC), Section 415 (Cheating) & Section 420 (Fraud).
6. Binding Agreement
By engaging with Kharakwal Media’s services, the client acknowledges and agrees to this strict No Refund & Cancellation Policy and waives any rights to claim, dispute, or demand refunds outside the provisions mentioned herein.
7. Governing Law & Jurisdiction
This policy shall be governed in accordance with the laws of India. Any disputes shall fall under the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh, India.
